1. Acceptance of Terms

Welcome to Termojet (the “App”), provided by TERMOJET SP Z O O (“we,” “us,” or “our”). By downloading, installing, or using the App, you (“user” or “you”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App.

3. App Description and Purpose

Termojet is a React Native utility and informational app designed to:

• Load and display a product catalog of heating and boiler room systems.
• Build an interactive scheme of how devices (our products) can be connected.
• Validate device connections.
• Provide detailed information about each device.
• Optionally generate a PDF that includes user-provided contact info, stored locally.

4. Eligibility

You must be at least the age of majority in your jurisdiction to use this App. By using the App, you represent that you meet this requirement. If you do not meet this requirement, you must not use the App.

5. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control. All rights not expressly granted to you are reserved by us.

6. Permissions Required

The App may request the following permissions:

• INTERNET – Required to access online resources and Firebase services.
• READ_EXTERNAL_STORAGE – To read or access files for App operations (e.g., PDF files).
• WRITE_EXTERNAL_STORAGE – To store or save data (e.g., generated PDF files) on your device.

7. No Mandatory Registration

The App does not require traditional user registration (i.e., no personal email, password, or name is collected by default). Instead, Firebase Anonymous Authentication is used solely to facilitate secure access to Firestore and other Firebase services.

8. Optional User-Provided Data for PDF

• When generating a PDF of the device scheme, you may optionally enter data (company name, location name, address, phone number, notes).
• This information is not stored on our servers or transmitted externally; it is stored locally on your device to populate the PDF.
• You can opt to skip providing this information; the PDF will be generated without any user contact details.
• Once generated, the PDF is stored locally on your device. Sharing or distributing the PDF is solely at your discretion.

9. User Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any law or regulation.
• Violate or encourage others to violate any rights of third parties.
• Upload or transmit any malicious code (e.g., viruses) through the App.
• Reverse-engineer, decompile, or otherwise extract the source code of the App.

We reserve the right to terminate or suspend your access to the App if we determine, at our sole discretion, that you have breached these Terms or any applicable laws.

10. Intellectual Property

• Ownership: We own and retain all rights, title, and interest in the App, including all associated intellectual property rights.
• Restrictions: You may not copy, modify, create derivative works of, distribute, or reverse engineer any part of the App unless expressly permitted by these Terms.

11. Third-Party Services

The App integrates with Firebase services (Firestore, Analytics, Crashlytics, Storage). Your use of these services through the App is subject to Google’s terms of service and privacy policies. If you downloaded the App from the Apple App Store, your use of the App may also be subject to Apple’s applicable terms and privacy policies. We do not control or assume responsibility for any third-party services.

12. No Ads, Crypto, or Prohibited Services

The Termojet App does not include any form of third-party advertising, cryptocurrency-related features, payment processing modules, government data access, or other functionalities that could violate Google Play or Apple App Store policies. The App is strictly limited to the product catalog, connection validation, and PDF generation features described elsewhere in these Terms.

13. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We specifically disclaim any and all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the fullest extent permitted by law, TERMOJET SP Z O O shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses arising from or in connection with your use of the App.

15. Indemnification

You agree to indemnify and hold harmless TERMOJET SP Z O O, its affiliates, and its and their employees, officers, agents, and representatives from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising from or in any way related to your use of the App or your violation of these Terms.

16. Termination

We reserve the right to suspend or terminate your access to the App, in whole or in part, at any time without notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease.

17. Governing Law

These Terms and any dispute arising out of or in connection with them shall be governed by the laws of Poland, without regard to conflict-of-law provisions. Any claims or disputes shall be brought exclusively in the competent courts located in Poland.

18. Changes to These Terms

We may update or modify these Terms at any time. If we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the App after the posting of any changes indicates your acceptance of those changes.
